This page outlines the procedures for resolving any legal disputes that may arise between you and Flexitools.io. By using our services, you agree to these terms.


1. Governing Law & Jurisdiction

Any claim, legal proceeding, or litigation arising in connection with the services offered by Flexitools.io will be governed by the laws of the Republic of India.

You agree to the exclusive jurisdiction of the courts located in New Delhi, India, for the resolution of any such disputes.


2. Informal Dispute Resolution

We believe most disagreements can be resolved informally. Before filing a formal claim, you agree to first try to resolve the dispute by contacting us. You can initiate this process by sending a written description of your claim to hi@flexitools.io.

We will try to resolve the dispute through email, phone, or other means of communication. Both parties agree to make a good-faith effort to settle the dispute informally for a period of at least thirty (30) days before initiating arbitration or court proceedings.


3. Binding Arbitration

If the dispute cannot be resolved informally, you and Flexitools.io agree that any and all disputes or claims arising out of or relating to your use of our services will be resolved by binding arbitration, rather than in court.

  • Arbitration Provider: The arbitration will be conducted by a neutral arbitrator, and the proceedings will be governed by the Indian Arbitration and Conciliation Act, 1996. The arbitration may be conducted through a recognized institution such as the Delhi International Arbitration Centre (DIAC), with the specific rules of that institution applying.

  • No Judge or Jury: There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award the same damages and relief on an individual basis that a court can.

Exception: Either party may bring a qualifying claim in a small claims tribunal in New Delhi, if applicable.


4. Class Action Waiver

All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding.

The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. By using Flexitools.io, you waive your right to participate in a class action lawsuit or class-wide arbitration.
